“An individual “A” signs an acknowledgment of debt in favour of “B”, in an amount of R 2 million, based on amounts advanced to him by “B”. When “B” issues a Court summons for payment, “A” asks whether “B” had been registered as a credit provider in terms of the National Credit Act. The act provides that a credit agreement is not valid if, at the time when the agreement was concluded, the credit provider was unregistered. “A” cannot claim payment from “B”. This principle applies to a bank summons or court summons if the consumer is an individual and the claimant is not registered as a credit provider, which often occurs ”.
